GOST R Declaration of Conformity is a permissive document issued against GOST R state standards on the obligatory basis (“Official Nomenclature of products subject to compulsory certification”, Government Decree No 982 by December 1, 2009). In these latter days “GOST R Declaration” document is progressively replaced by new declarations issued against new Technical Regulations of the Customs Union.
An official document called “TR Declaration of Conformity for Customs Union” is issued with the aim to ascertain the product quality and safety, and to prove that the product in question complies with all the required standards described in applicable Technical Regulation. Some time ago on the territory of Russian Federation this type of certification was carried out in accordance with national standards GOST R, but due to the fact that GOST R standards are being gradually replaced by Customs Union’s Technical Regulations, Lately more and more goods and products get certified against new harmonized CU TR standards.Due to that reason declaration procedure against the new requirements becomes more and more common. At the present moment several dozen Technical Regulations to Customs Union are already in effect, amongst which are Technical Regulations on Food Safety, TR on Safety of products of light industry, TR on Safety of machines and industrial equipment, TR on Safety of products for children and teenagers, and a lot more.
Declaration against the requirements of new regulations is carried out in strict accordance with the requirements of Customs Union, and the actual document is issued and gets registered in Unified Register only after all the checks and testing required by corresponding Technical Regulation.
As far as GOST R Declaration of Conformity is concerned the old ones received under GOST R requirements are still valid up to expiration date of the permissive document itself, even if the newest Technical Regulations have been approved for the products, mentioned in those old declarations. However the maximum duration of the validity for those declarations cannot exceed the time limits indicated in appropriate current Technical Regulation.
As for the peculiar properties and features of the GOST R declaration as the permissive document it is worth noting several most important of them. First of all GOST R Declaration is always draw up on behalf of the applicant,because the biggest part of the responsibility for the data included in a declaration lies with the recipient. Due to that reason declaration cannot be drawn up on behalf of the non-Russian legal entity.
One more difference is that (unlike GOST R Certificate) GOST R Declaration is issued on a mandatory basis only. An additional voluntary certification could be carried out on the initiative of the applicants with the aim to formally prove the safety of their products. In this case the applicant has a right to choose the exact standard compliance to which is to be ascertained.
